Terms of Service & License
These terms are an agreement between you and Heavin Astern LLC ("Heavin Astern," "we," "us") governing your use of the Figured app. By downloading or using Figured, you agree to them. If you don't agree, please don't use the app.
Your license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Figured on Apple devices you own or control, for your own non-commercial use, in line with the App Store Terms of Service. We keep all rights not expressly granted here.
The app and its content
Figured presents short biographies of historical and public figures for general informational and educational purposes. We work hard to be accurate, but the content may contain errors, omissions, or simplifications and shouldn't be relied on as authoritative, professional, or academic reference. The biographies, text, design, and artwork in the app are owned by Heavin Astern or used with permission, and are protected by intellectual-property laws.
Subscriptions and purchases
Some features may require a paid subscription. If you buy one, billing is handled by Apple through your Apple ID. Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period; you can manage or cancel in your Apple ID settings. Prices and included features may change, and we'll tell you before a change takes effect. Except where required by law or by Apple's policies, payments are non-refundable.
Using Figured responsibly
You agree not to: copy, resell, or redistribute the app or its content; reverse-engineer, decompile, or attempt to extract source code or the underlying data set; use the app unlawfully or to infringe others' rights; or interfere with or disrupt the service. Where the app lets you report ("flag") content, you agree to use that feature in good faith.
Disclaimer of warranties
Figured is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted or error-free, or that its content is accurate or complete.
Limitation of liability
To the fullest extent permitted by law, Heavin Astern will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Figured. Our total liability for any claim relating to the app will not exceed the amount you paid us for it in the 12 months before the claim, or USD $50 if you paid nothing.
Termination
You may stop using Figured and delete your account at any time. We may suspend or end your access if you breach these terms or to protect the service. Sections that by their nature should survive termination will survive.
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules.
Apple App Store
Because you obtain Figured through Apple's App Store, the following also apply:
- These terms are between you and Heavin Astern only, not Apple. Heavin Astern — not Apple — is solely responsible for Figured and its content.
- Your license to use Figured is limited to Apple devices you own or control, as described above and under Apple's Usage Rules.
- Apple has no obligation to provide maintenance or support for Figured; that is our responsibility.
- If Figured fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for Figured, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- Heavin Astern, not Apple, is responsible for addressing any claims relating to Figured, including product-liability, legal or regulatory, and consumer-protection claims, and claims that Figured infringes a third party's intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes
We may update these terms. If changes are material, we'll update the date above and, where appropriate, let you know in the app. Continuing to use Figured after a change takes effect means you accept it.
